I am writing to you regarding your upcoming review of Rinehart vs The State of California, 16-970.

Please carefully review this case and base your decision on the facts of the case, the intent of congress, the long history of case law, and the question that is actually before the court. The implications of allowing state authorities to completely obstruct development of minerals on the federal lands will have catastrophic consequences to the future of America’s economy.

The Solicitor General failed to address the real matters at stake in his brief. The brief completely circumvented the Federal Preemption question before you. The brief cites the state is working on addressing the issue, but the state has failed to do so in nine years and it is just using its process to prevent mining on the federal lands. In fact, the brief looks to be drafted by the very same anti-mining, anti-American value special interests that have put small-scale miners out of business.

Several other states have followed California’s unscrupulous behavior and have issued similar obstructive regulation on federally managed lands.

President Trump has stated his intent to develop natural resources on federally managed lands and is already facing similar challenges that will eventually reach your court in some distant future. After being regulated out of existence for nearly a decade and fighting all the way up to your court, we hope to see the matter resolved at this opportunity.

I am enclosing a letter written by the attorney who has helped us all the way from the beginning. He expresses my concerns in legal terms that may be helpful.
